सामाजिक सञ्जाल फेसबुकमा सार्वजनिक भएको एक गम्भीर आरोपलाई लिएर चर्चित कलाकार सागर लम्साल ‘बले’ लाई प्रहरीले नियन्त्रणमा लिएको छ। करिब एक वर्षअघि अमेरिकामा भएको भनिएको एक घटनाको विषयमा फेसबुकमा पोस्ट सार्वजनिक भएपछि प्रहरीले उनलाई काठमाडौँको बुढानीलकण्ठबाट नियन्त्रणमा लिएको हो।
तर, पर्याप्त कानुनी आधार, क्षेत्राधिकार र ठोस प्रमाणको अभावमा प्रहरीले उनलाई कुन मुद्दा चलाउने भन्नेमा अन्यौल देखिएको छ।
के हो घटना ?
करिब एक वर्षअघि अमेरिका भ्रमणका क्रममा कलाकार लम्सालले आफूमाथि यौन दुर्व्यवहार (बलात्कार) गरेको भन्दै हाल अमेरिकामा रहेकी एक युवतीले फेसबुकमा पोस्ट गरेकी थिइन्। सोही सामाजिक सञ्जालको चर्चा र दबाबका आधारमा जिल्ला प्रहरी परिसर काठमाडौँले उनलाई सोधपुछका लागि भन्दै हत्कडी लगाएर नियन्त्रणमा लिएको छ। यद्यपि, हालसम्म सो घटनाका सम्बन्धमा पीडित भनिएकी व्यक्तिबाट आधिकारिक निकाय वा प्रहरीमा औपचारिक उजुरी (जाहेरी) दर्ता नभएको स्रोतले जनाएको छ।
कानुनी जटिलता र क्षेत्राधिकारको प्रश्न
घटना भएको भनिएको स्थान (अमेरिका) र समय (एक वर्षअघि) का कारण यो अनुसन्धान थप चुनौतीपूर्ण बनेको छ। कानुनी विज्ञहरूका अनुसार यस मुद्दामा मुख्य दुईवटा जटिलता देखिएका छन्:

क्षेत्राधिकार: नेपालको कानुनअनुसार विदेशी भूमिमा भएको घटनामा अनुसन्धान र कारबाही गर्ने प्रक्रिया निकै जटिल हुन्छ, विशेष गरी जब दुवै पक्ष फरक-फरक देशमा रहेका हुन्छन्।

प्रमाणको अभाव: फेसबुक स्टाटसबाहेक अन्य कुनै ठोस भौतिक वा प्राविधिक प्रमाण फेला नपर्दा प्रहरीलाई मुद्दा प्रक्रिया अगाडि बढाउन कठिन भएको छ।
विज्ञहरूका अनुसार, औपचारिक जाहेरी बिना केवल सामाजिक सञ्जालको ‘भाइरल’ पोस्टकै भरमा गरिने पक्राउले ‘प्रक्रियागत त्रुटि’ निम्त्याउन सक्छ र अदालतमा यस्तो मुद्दा कमजोर ठहरिने सम्भावना रहन्छ।
प्रहरीको अन्यौल र दबाब
पक्राउ परेका लम्साललाई कुन कानुनी दफाअन्तर्गत कारबाही गर्ने भन्नेमा अनुसन्धान अधिकारीहरू नै निष्कर्षमा पुग्न सकेका छैनन्। काठमाडौँ प्रहरी प्रमुखका अनुसार अहिले उनलाई नियन्त्रणमा लिएर सूक्ष्म अध्ययन भइरहेको छ।
“हामीले घटनाको गम्भीरतालाई हेरेर उनलाई नियन्त्रणमा लिएका हौँ। पीडित भनिएकी युवतीसँग समन्वय गर्ने प्रयास भइरहेको छ,” एक प्रहरी अधिकारीले बताए।
निष्कर्ष
एकातिर घटनाको गम्भीरतालाई हेर्दै निष्पक्ष छानबिन हुनुपर्ने र दोषी देखिएमा कानुन बमोजिम कडा कारबाही हुनुपर्ने दबाब छ। अर्कोतिर, प्रमाणविहीन आधारमा र कानुनी प्रक्रिया पूरा नगरी केवल सामाजिक सञ्जालको होहल्लाकै भरमा निर्दोष व्यक्ति फस्न नहुने तर्क पनि उत्तिकै बलियो देखिएको छ। यो घटनाले नेपाली कानुनमा ‘सोसल मिडिया ट्रायल’ र वैदेशिक क्षेत्राधिकारको विषयमा नयाँ बहस सिर्जना गरेको छ।
